Pre-Lease Advisory

The best time to examine how your lease works for you is before it has even been signed.  Your solicitor will review the draft lease and be able to advise on some technical matters, however, the translation from wording to implementation in practice is the realm of the surveyor.  The impact of a poorly drafted rent review clause for instance could have serious financial implications further down the line.  Alternatively, the effect of a particular service charge provision might lead to future dispute.  In short, it’s beneficial to consider the entirety of the lease in practical terms before the agreement is formalised.  Chambers Surveyors can advise you prior to agreeing a lease and reduce the chances of future problems.

Lease Restructure or Re-gear

writing, pen, manIt is often the case however that problems have arisen mid-lease and that one party (or indeed both) would wish to amend the terms of the lease to better reflect the relationship.  Perhaps the tenant’s business has evolved and the existing user clause is too restrictive, or perhaps the landlord would want to re-gear the lease to maximise investment value – in any case it is not uncommon for parties to a lease to wish to renegotiate certain terms to better reflect their requirements.  At Chambers Surveyors, we can advise on – or indeed handle – negotiations for lease restructuring or re-gearing in order to ensure that the landlord & tenant relationship remains beneficial to both parties. 

Lease Surrenders

Sometimes, continued occupation of commercial premises may no longer be viable to the tenant.  If this is the case, we can act on your behalf to seek to negotiate a potential surrender of your lease to provide you with an exit strategy.  Alternatively, if you are a landlord who would rather regain leased accommodation, we can assist in negotiating a settlement with your tenant.
