Rights to Light

Rights to Light are often misunderstood to form part of the Sunlight & Daylight planning process, however, they are actually a legal matter quite separate to that process.  Even if planning permission has been granted, your rights to light may be infringed or you may still infringe if you are a developer.  For the injured party, you may be able to obtain financial damages or an injunction… and for the developer you may have to pay those damages or have your scheme prohibited.

At Chambers Surveyors, we can provide preliminary advice to developers or neighbours as to the impact of the proposed development on any rights enjoyed.  Our typical services consist of:

Service Charge Consultancy

Service Charges can be complex and daunting at first glance, but the general principle is a simple one – a charge to deal with the costs of servicing and operating a property, to comply with the landlord lease obligations for the provision of services.  The complexity arises from the vast range of properties and services, and the various different methods for accounting for the costs.

Over the past 25 years or so, collaborative industry guidance has developed in to what has been known as the Service Charge Code – now incorporated into mandatory compliance by RICS members.  We can offer advice to occupiers as to the many aspects of compliance by it’s landlord, or indeed to landlords to ensure that they remain compliant.  Contact us for more information.

 
Compulsory Purchase

Compulsory Purchase Orders (CPO’s) provide acquiring authorities the power to compulsorily purchase your property.  If you own, rent, or occupy a property which is subject to the CPO, you will be served notice and entitled to compensation under the principles of the compensation code.  One of the main principles of the Code is that of equivalence, whereby an affected party should not be put in any worse or better financial position than they were prior to the acquisition.
