Lease Renewals
The expiry and renewal of commercial leases are usually subject to the statutory provisions of the Landlord & Tenant Act 1954. The process of renewal can be initiated by the landlord by way of a Section 25 notice, or by the tenant via a Section 26 request. It is important to know the legal procedure and timeline so as to ensure that notices aren’t served invalidly, or that key dates aren’t missed which could have serious consequences.
Once a notice or request is served, the parties usually commence a period of negotiation in order to resolve the terms of the new lease. However, if the parties are unable to agree the new terms, they have the option to refer the matter to Court in order to resolve. It is critical that the parties are informed as to the process, timescales, costs, market conditions, and negotiation tactics in order to navigate the renewal to a beneficial conclusion.
